​Before you proceed with purchasing a session, consultation or one of the services (referred to from hereinafter as our "product line") offered on this Water Medium Synergy website we would like to first identify to you our applicable terms of use and conditions that apply for all communications, payments, scheduling, cancellation and refund activities undertaken by any user / client and which shall remain in effect at all times to avoid any possible future misunderstandings or confusions as they may arise. Proceeding with your purchase of any product line that Water Medium Synergy offers through this website shall be considered as your full agreement and acceptance of each of the terms of use and conditions listed herein below.

PAYMENTS & REGISTRATION POLICY:

1.) Any on-line payment for a "product line" as selected by you from this website shall be made using the on-line payment options offered on this website through Pay-pal to Water Medium Synergy. Such payment shall be made in full at the time of purchase with the understanding and agreement that the appointment date and time (and location for any product line to be delivered by us in person as applicable for select "product lines") shall be arranged and confirmed by us by email to you after your payment has been received by us in full. Some "product line" listed on this website might already have a preset appointment date and time and/or location identified where in such circumstance you are asked to carefully consider the identified details of when and where the "product line" will be offered by Water Medium Synergy before you make your on-line payment because the shown dates and times for such select "product line" listings are considered as non-negotiable and your payment will make your registration (for that "product line" you selected) deemed as full and final and non refundable in full or in part unless stipulated otherwise in the subsequent section titled; "Cancellation Policy".

2.) Once your submitted payment has been received in full by Water Medium Synergy - we will email your payment confirmation to you - at which time you will be officially deemed registered for that "product line". 

3.) In addition to emailing you your confirmation notice of your payment and registration for the selected "product line" - we will ask you at that time to provide us by email with your availability and preference of upcoming dates and times we presently have available from which ones we will ask you to select your "product line" to be delivered on by Water Medium Synergy. The information you provide to us in your e-mail response will assist us in cross referencing your preference with our availability in our schedule to arrange and confirm the date and time (and location as applicable for any in-person "product line" selected at time of your purchase) and when we can offer it (your upcoming "product line") by phone or email or in person (depending on the type and nature of your selected and paid for delivery mode of your "product line").

4.) Water Medium Synergy cannot issue any guarantees or warranties on how soon your selected and paid for "product line" will be delivered to you as that is largely dependent on your availability and preference of dates and times which will need to coincide with our availability and around our other already confirmed and scheduled appointments with our other already registered clients. What we can guarantee is that we will make the necessary timely effort to make the necessary scheduling arrangements with you as soon as possible after your payment in full has been received by us.

5.) Once the date and time (and location as applicable to your selected and paid for "product line") is agreed to by both you and Water Medium Synergy - we will email you with a registration confirmation details of when and how your "product line" shall be delivered and what if any instructions may be necessary for you to follow prior to your confirmed appointment date and time - to make your "product line" experience a success. (For example for a handwriting analysis being requested over the internet we will require you to forward the handwriting sample to us by email at least 2 days in advance of your confirmed booking.) 

​6.) All communications pertaining to any administrative logistics, requests, concerns, and/or issues (e.g., including but not limited to confirmations, payments, scheduling,  cancellations, accommodation needs etc..)  are to be limited and restricted to ONLY EMAIL WRITTEN CORRESPONDENCE COMMUNICATIONS between any party. Furthermore, in the event of a disagreement on facts or any arising disputes between you and Water Medium Synergy - ONLY email correspondence communications shall serve as the sole valid documentation and prevailing determinant of facts in accordance to the setforth terms and conditions herin. For this reason we require you to please communicate with Water Medium Synergy by email only as written correspondence shall always prevail as the absolute determinant of information exchanged and shall supersede over any claims or reference made to alleged verbal communications held by phone or in-person discussions. 

7.) In addition to Water Medium Synergy offering various list of in-person, phone and email WMS services on this website that can be purchased through PayPal - Water Medium Synergy also offers several of its WMS services by phone and email via third party provider Click-4Advisor. Click-4Advisor Phone and/or Email Services are offered to those seeking instant connection or to receive a call-back through a double-blind connection for added privacy. Anyone interested in proceeding to book a WMS session using Click-4Advisor phone or email services with Water Medium Marlene (founder of WMS) will need to first register for a Click-4Advisor user account. Governing Law

This Agreement is to be construed in accordance with and be governed by the Province of Ontario and the federal regulatory laws of Canada where Water Medium Synergy's business base is operating from and where all product line payments are received - where location or modality of delivery of any purchased "product line" is deemed as non-material and shall not invalidate the terms and conditions set herein this purchase agreement 

Dispute Resolution

1.) In the event any dispute may arise under this Purchase Agreement - both parties hereby agree in advance that all reasonable efforts to attempt to bring forth a positive resolution and mutually acceptable outcome to all the disputes in question shall be exhausted. All reasonable efforts herein constitute of both parties engaging in good faith into a healthy and productive discussion to arrive at a mutually agreed to timely resolutionwithin and no more than 3 months.

2.) Only after both parties fail to arrive at a mutually acceptable resolution to all of their disputes shall that dispute proceed to being heard by a licensed mediator who is to be retained from a regulated and licensed Dispute Resolution Centre operating in Toronto, Ontario, Canada where all associated costs of the requested mediator and their services, costs, and fees shall be split and paid for equally by both parties.

3.) In the event and only if all reasonable efforts made to resolve the dispute have been exhausted including where the mediation has failed to produce a settlement agreement to resolve the disputes shall the matter of all disputes be pursued through Arbitration by either or both parties.

4.) Both parties further agree that proceeding to Arbitration to having their disputes settled by arbitration is limited to;

(a) within 1 year following mediation failing; and

(b) for the Arbitration preceding to be scheduled in the city of  Toronto, in the province of Ontario in Canada before a single arbitrator to be selected and approved by Water Medium Synergy pursuant to the commercial law rules of the Law Society of Upper Canada.

5.) In the event any of the cited terms and conditions herein this Agreement the above cited Paragraph (4) fail to be met in part or in whole by either party shall render all of the matters directly or indirectly associated to the disputes to be abandoned an no longer legally actionable for resolution in the future under either Arbitration or under any other legal preceding by either or both parties in any legal jurisdiction.

6.) Pursuit for resolution through Arbitration as stipulated herein and all of the terms and conditions of above Paragraph (4) in this section being met by both parties also further requires either party hereto giving advance written notice to the other party by registered mail to serve as proper accepted notification that such dispute has been referred to arbitration for resolution. Failure of such notification using registered tracked mail service shall render all matters of the dispute as closed and voided including no longer legally actionable or disposed of in part or in whole by either party under any other legal framework where-ever or however in the future.

7.) Any award rendered by the arbitrator shall be deemed accepted as absolute, conclusive and binding upon all the parties hereto. 

8.) This provision for arbitration shall be specifically enforceable by all concerned parties and the arbitrator's decision in accordance herewith shall be full, final and binding without right of appeal by any of the parties or a.k.a. "litigants" in the arbitration. 

9.) It is further understood and agreed by all parties that any frivolous and/or vexatious legal course of action brought to Arbitration or any other legal preceding which is commenced and pursued with mal-intent or in bad faith by any party or parties shall entitle the injured party to financial compensatory relief from the the culpable party responsible for initiating such bad-faith claim for any and all direct and indirect past, present and associated projected future damages, costs and/or losses including all legal fees, disbursements and costs in order to be made whole.

Severability

If any provision of this Agreement shall be held to be illegal, invalid or unenforceable under present or future laws, such provisions shall be fully severable, and this Agreement shall be construed and enforced as if such illegal, invalid or unenforceable provision had never comprised a part of this Agreement; and, the remaining provisions of this Agreement shall remain in full force and effect.

 Limitation of Liability

IN NO EVENT SHALL EITHER PARTY BE LIABLE TO THE OTHER PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, BUSINESS INTERRUPTION, LOSS OF OR UNAUTHORIZED ACCESS TO INFORMATION, DAMAGES FOR LOSS OF PROFITS, INCURRED BY THE OTHER PARTY ARISING OUT OF THE SERVICES PROVIDED BY WATER MEDIUM SYNERGY UNDER THIS AGREEMENT, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL NEITHER PARTY'S LIABILITY ON ANY CLAIM, LOSS OR LIABILITY ARISING OUT OF OR CONNECTED WITH THIS AGREEMENT EXCEED THE AMOUNTS PAID HEREIN TO WATER MEDIUM SYNERGY BY THE CLIENT.

Indemnification

Every client agrees to indemnify at its own expense and hold Water Medium Synergy and its owner(s), affiliates, subsidiaries, successors and assigns officers, directors, employees, sublicensees, and agents harmless from and against any and all claims, losses, liabilities, damages, demand, settlements, loss, expenses and costs (including legal fees and/or all disbursements, and court costs) which arise directly or indirectly out of or relate to any breach of this Agreement including any scope of negligence or willful misconduct. 

Entire Agreement; Amendment:

This Agreement is the final, complete and exclusive agreement between and of the parties with respect to the subject matter hereof and supersedes and merges all prior or contemporaneous representations, discussions, proposals, negotiations, conditions, communications and agreements, whether written or oral, between the parties relating to the subject matter hereof and all past courses of dealing or industry customs. No modification of or amendment to this Agreement shall be effective unless presented in writing and signed and dated by each of the respective parties named within any such amendment.

Waiver

The waiver by either party of a breach of or a default under any provision of this Agreement shall not be effective unless in writing and shall not be construed as a waiver of any subsequent breach of or default under the same or any other provision of this Agreement, nor shall any delay or omission on the part of either party to exercise or avail itself of any right or remedy that it has or may have hereunder operate as a waiver of any right or remedy.

Captions

The headings used in this Agreement are for convenience only and shall not be used to limit or construe the contents of any of the sections of this Agreement.

​CANCELLATION TERMS / REFUND POLICY AFTER PAYMENT MADE TO WATER MEDIUM SYNERGY:

​1.) In the event you accidentally select and pay for a particular "product line" other than the one you actually intended to select (e.g., by clicking on a wrong "product line" from the drop down menu") - we ask that you email us as soon as possible at info@watermediumsynergy.com to advise us of your purchasing error. We will be more than happy to transfer your full payment amount against the value amount of the "product line" you wish to purchase - provided your email request is issued to us within 48 hours following your original payment - otherwise the subsequent paragraphs (as applicable to identified timeline notification requirements) in this Cancellation Policy Section shall apply and prevail over all conditions and offers found in this paragraph. If following receipt of your email request the intended "product line" you wish to receive and purchase is of higher value than what you paid we will issue you an invoice for the difference amount which will be due and payable by you at time of receipt.  In the event your intended "product line" you wish to receive and purchase is of lesser value you will have the option of receiving the difference in amount as a cash refund deposited electronically to your account (subject to a 15% withholding processing and handling fee) or you can opt to receive a Credit Voucher from Water Medium Synergy in the differential amount value between what you originally paid and the lesser amount value of the newly "product line". For terms and conditions of use of our Credit Voucher please refer to the section further below titled; "Credit Voucher Policy & Terms of Use".

2.) If after any payment is made by you to Water Medium Synergy (whether on-line or directly in an alternate form) where you wish to cancel your purchase order for a particular "product line" - we will require you to contact us by email at info@watermediumsynergy.comwithin 48 hours after you made your payment in order for you to qualify for a full refund minus a 15% withholding processing and handling fee that will be deducted by Water Medium Synergy from your original sum payment being refunded to you electronically to your account. This 15 % administrative service fee is applied to cover our administrative processing and handling costs and/or any other incurred service fees. (For example if your payment may have been $100 then your cash refund being returned to your account shall be $85.)

​3.) Any purchase cancellation requests you wish to make after 48 hours of submitted payment must be submitted to us by email at; info@watermediumsynergy.com at least 10 calendar days before the start date and time of that selected "product lines" - otherwise the next par. 3 below shall apply. Once we receive your request to cancel your purchase in accordance to the terms and time frames noted herein - we will issue to you a Credit Voucher in the amount you originally paid for the "product line" you are cancelling - minus a 15% withholding administrative processing and handling fee from your total payment sum. For details on the conditions and terms of use of our Credit Voucher - please refer to the section further titled, "Credit Voucher Policy & Terms of Use".

​3.) In the event you want to cancel your purchase less than 10 days prior to the confirmed start date and time of a particular "product line" which you paid for - you will need to email your cancellation request to us at; info@watermediumsynergy.com. Please be advised that we will unfortunately not be able to issue any cash refund in part or in full of the original payment amount you made. What we can do is offer you a Credit Voucher in the value amount of 50% off the payment amount you made for that particular "product line" you are requesting to cancel. For details on the conditions and terms of use of our Credit Voucher - please refer to the section further titled, "Credit Voucher Policy & Terms of Use".

4.) As noted above in each of the preceding paragraphs herein all cancellations requests shall only be accepted in writing when sent directly by email to Water Medium Synergy within the stipulated time frames noted in the a fore par. 1-3. Also any cancellation requests made over the phone or verbally in-person and/or otherwise shall not be accepted, processed nor considered for any form of reimbursement by Water Medium Synergy for whatever reason.

5.) In the unlikely event a cancellation request was allegedly sent to us at Water Medium Services but not received on our end for whatever reason shall deem the cancellation request as not having met the necessary terms and conditions as noted herein in the paragraphs 1-3 above. Only if you can provide sufficient documented written proof and electronic submission confirmation evidence to prove to the contrary that your request was sent as required herein - may your requests, claims or expectations be considered for a full or partial refund or credit voucher in the amount representing the purchased "product line" you intend to cancel - provided you met the explicit terms and conditions set out herein in this cancellation policy section. 

RESCHEDULING & MISSED APPOINTMENTS REQUESTS MADE BY CLIENTS: 

Water Medium Synergy (WMS) understands that at times some unexpected emergency or unforeseen events may arise which can prevent one from attending or participating in a "product line" that they previously purchased and confirmed to attend. Hence we at WMS will gladly try to assist you to our best abilities to reschedule in accordance to the following terms and conditions set out in this policy governing rescheduling needs and missed appointments:

​1.) If due to unforeseen circumstances that are beyond your control and preventing you from attending/participating in a "product line" which you already have purchased and were confirmed to partake in on or to receive on a particular date or time - we will require you to notify us in writing by email at your earliest opportunity to advise us of your scheduling conflict and need to reschedule your appointment for another date and time. Upon receipt of your emailed rescheduling request we will advise you by email of the next available date and time we can offer to you in accordance to our schedule and availability. 

2.) Emailed requests for rescheduling submitted to Water Medium Synergy must be at least 3 or more days in advance of the appointment date on which your "product line" was confirmed in writing to be held. We will try to accommodate such rescheduling requests to our best ability and availability to offer you access the same "product line" in the near future. A reasonable and nominal administrative rescheduling fee of $10 USD shall apply. An invoice for the $10 USD rescheduling service fee will be issued to you on-line that you will need to pay in advance of your newly scheduled "product line" appointment's start date / time.

3.) Emailed requests for rescheduling submitted to us 2 days or less (including the day of) to the previously confirmed start date and time of your appointment for the said "product line" - we shall try to accommodate in the same manner as identified in the above par. 2 of this section - with the exception that a $20 USD rescheduling service fee shall apply to all rescheduling requests received 2 days or less from the confirmed start date and time of the said "product line". An invoice for the $20 USD rescheduling service fee will be issued to you on-line that you will need to pay in advance of your newly scheduled "product line" appointment's start date / time.

4.) In the event you miss your appointment all together without advising Water Medium Synergy in advance by email as per the identified time frames in the above par. 1-3 in this section (OR) you contact us 2 or more days post your missed previously confirmed appointment date - it is hereby understood and agreed by you that you have forfeited any and claims to any refund or Credit Voucher to be issued to you by Water Medium Synergy for the missed "product line" session you previously purchased.  

5.) In the event of an emergency that was beyond your control and which prevented you from contacting Water Medium Synergy in advance by email to advise you would not be able to attend your confirmed "product line" appointment date and time. Where you contact us by email no more than 1 day after with a reasonable explanation why you were unable to attend on that date and time of your previously confirmed appointment - we at Water Medium Synergy shall use our sole discretionary power and right at that time to determine whether a Credit Voucher can or may be offered to you in the full value of the missed session minus a $20 USD rescheduling administrative service fee. No refunds in part or in full shall be extended to anyone regardless if the terms in this paragraph are met or not.  If a Credit Voucher shall be issued to you then the terms and conditions set out in the "Credit Voucher Policy & Terms of Use" section listed further below shall apply.

​RESCHEDULING & CANCELLATION INITIATED BY WATER MEDIUM SYNERGY:

We understand that at times some unexpected emergency or unforeseen events may at times also arise on our end that may be beyond our control and which may prevent us to deliver on a previously confirmed appointment date or time (or at a specific location if and as applicable to in-person sessions) for an already purchased "product line" by you. In such circumstances we will notify you by email in advance to our best ability as soon as we can to inform you of the required scheduling change for your session "product-line" appointment date and time (and location if and as applicable to any in-person "product line" sessions). In our email we will also make every effort to reschedule the "product line" to another date and time as per the following terms and conditions: 

1.) Water Medium Synergy will do its best to work within your availability to reschedule any purchased "product line" to another convenient appointment date and time that shall meet and accommodate both your and our Water Medium Synergy availability and schedule. In addition to our rescheduling efforts we will also issue to you a Credit Voucher in the value amount of $50 USD for you to apply against another future "product line" of your choice that we at Water Medium Synergy will be offering over the next 12 months. This Credit Voucher will be subject to the same terms of use and conditions as stipulated in the next section herein below titled;"Credit Voucher Policy & Terms of Use".

2.) In the event our proposed dates or times to reschedule your appointment will not be possible for you to attend we will refund your payment in full for the cancelled appointment and also issue you a Credit Voucher in the value amount of $50 USD for you to apply against another future "product line" of your choice that we at Water Medium Synergy will be offering over the next 12 months. This Credit Voucher will follow and have the same terms of use and conditions apply as stipulated herein in the next section below  titled "Credit Voucher Policy & Terms of Use".

3.) It is further understood and agreed by you that in the event a prior confirmed "product line" appointment becomes cancelled for whatever reason by us at anytime we at Water Medium Synergy will not be responsible or liable to compensate you or anyone else that may be adversely affected in whatever manner for any costs, losses or damages whatsoever that may result directly or indirectly from the scheduling mishap or our need to cancel any previously confirmed and purchased "product line". You further agree and accept that the only compensatory maximum relief amount to be paid to you by us - Water Medium Synergy (to satisfy us having had to cancel or request rescheduling your prior confirmed appointment session) shall be limited and shall not exceed the monetary value amount you had paid for that said product line session, AND you further agree that Water Medium Synergy's refund to be deemed by you as full and final, sufficient, satisfactory and all inclusive as identified in the above pars. 1 - 2 in this section and shall at no point in time for whatever reason ever exceed the actual value of the actual amount paid by you for the "product line" that may become cancelled or needing to be rescheduled by Water Medium Synergy.

​CREDIT VOUCHER POLICY & TERMS OF USE:

If you have received a Credit Voucher from Water Medium Synergy then the following terms and conditions of use shall apply as identified in the following par. 1 - 8. Before proceeding with using your Credit Voucher against the purchase of a "product line" on this website please email us first at info@watermediumsynergy.com so we can process your purchase order by applying your Credit Voucher according to the applicable cited conditions and terms of use terms listed below in this section: 

1.) Credit vouchers issued by Water Medium Synergy are non-transferable and must be used within 12 months from the date of issue by the individual to whom it was originally issued towards the purchase of another "product line" of their choice being offered by Water Medium Synergy during that one (1) year time frame. 

2.) Credit vouchers issued by Water Medium Synergy are also not redeemable for cash value nor can they be sold or gifted by its rightful designate to someone else for their use or purchase of our "product line". Any credit voucher presented or claimed by someone other than to whom it was originally issued by us shall deem that credit voucher as null and void where its holder or anyone else shall hold no further recourse for any claims for losses, compensatory relief in part or full, nor will they hold the right to any further actionable claims for any type of remuneration remedy, nor any other type of expectation for any reimbursement or award in part or in full from or against Water Medium Synergy or its owner(s), affiliates, subsidiaries, successors, operators and / or assigns officers, directors, employees, sublicensees, or agents.

​3.) Any credit voucher issued to you by us at Water Medium Synergy shall be valid for a period of 12 consecutive months starting from the date and month of its issue, after which time if not used the credit voucher shall be deemed as expired and null and void and no longer usable towards any future purchase of any "product line" being offered by Water Medium Synergy in the present or future. Furthermore, once a Credit Voucher is deemed to be expired the holder of the Credit Voucher shall hold no further recourse for any claims for compensatory relief in part or full, nor will they hold the right to any further claims whatsoever for any remedy, nor hold any rights on any other type of expectation for reimbursement or award in part or in full from or against Water Medium Synergy or its owner(s), affiliates, subsidiaries, successors, operators and / or assigns officers, directors, employees, sublicensees, or agents.

4.) Upon receipt of a credit voucher you will be able to apply its value against the purchase of another "product line" in the same or lesser value during the period of 12 months from the date the credit voucher was issued to you.

5.) Credit vouchers more than 12 months old shall be deemed as expired and any amount value remaining on the Credit Voucher shall become null and void with no further recourse for any compensatory relief in part or full nor will you hold any right to any further claims whatsoever for any remedy, nor hold any rights on any other type of expectation for reimbursement or award in part or in full from or against Water Medium Synergy or its owner(s), affiliates, subsidiaries, successors, operators and / or assigns officers, directors, employees, sublicensees, or agents.

6.) If you select a "product line" of a lesser value amount than the amount sum your credit voucher holds -  then you understand and agree that you will permanently forfeit without any further recourse or expectation to making any future claim for the remaining balance on your credit voucher issued by Water Medium Synergy.

7.) If you select a "product line" of a higher value amount than the amount you hold on Credit Voucher - we at Water Medium Synergy will issue you an invoice for the amount difference which shall be due at time of receipt and will need to be paid in full for you to proceed with your registration for the newly selected "product sum" of higher value than your Credit Voucher value amount holds.

8.) Credit Vouchers issued by Water Medium Synergy that have not expired can be combined by an individual towards the purchase of another "product line" with the understanding and agreement that the terms of use and conditions of this "Credit Voucher Policy" herein are deemed and agreed to by all as being non-revocable and applicable without exception.

​9.) Credit Vouchers only issued by Water Medium Synergy shall be recognized as the sole official and valid tender to be applied against any purchase of a "product line" listed on this website where at no time shall anyone attempt to sell, alter, make copies, effect reproductions or attempt to circulate a falsified Credit Voucher for any reason or purpose whatsoever - where any such discoveries (direct or indirect) by Water Medium Synergy shall result in the original Credit Voucher and / or any of its altered, reproduced or falsified copies deemed null and void by Water Medium Synergy without further notice nor entitling the rightful owner or anyone else to any compensatory relief, any refund in part or in full amount of the Credit Voucher value once it has been revoked and deemed null and void by Water Medium Synergy for whatever reason at anytime. 

10.) Any holder and/or any individuals found party in violation at anytime or in any part of this "Credit Voucher Policy" set forth herein this section further understand and agree that legal actions may be brought against them by Water Medium Synergy at its sole discretion whenever fraudulent misuse of Credit Vouchers is suspected and/or found to be committed - where any resulting past, present or future costs, losses and damages whatsoever incurred or to be incurred by Water Medium Synergy caused by someone found or suspected of violating any of the conditions or terms of use herein as identified in this section "Credit Voucher Policy" - shall be pursued for compensatory relief by whatever legal options and avenues available to Water Medium Synergy including seeking recovery for all incidental and associated legal costs that Water Medium Synergy may incur in such legal undertakings.  

11.) All purchasers further understand and agree that Water Medium Synergy holds the sole discretionary right to invalidate a Credit Voucher at any time when suspicious or fraudulent use of such is suspected or discovered where the holder and/or any individual(s) hereby agree to be bound by Water Medium Synergy's decision to declare their Credit Voucher as null and void at anytime including them further agreeing to forfeit any further recourse for any claims of action sought out for their compensatory relief in part or in full in the future against Water Medium Synergy. Furthermore all parties also understand and hereby agree that once a Credit Voucher has been nullified and voided by Water Medium Synergy for violation of any of the paragraphs found herein this section governing "Credit Voucher Policy" shall constitute as absolute and final without anyone whosoever holding any further claims of entitlements, expectations or demands for compensatory relief in part or in full in any amount from Water Medium Synergy at anytime thereafter. 

​GIFT CERTIFICATE and GIFT VOUCHER POLICY: 

​Water Medium Synergy offers gift certificates and/or gift vouchers for sale to anyone interested in purchasing one for someone to use towards the purchase of one of our "product line" listed on this website where each of the above noted policies shall apply as pertaining to purchase of any of WMS services we offer and have listed on Water Medium Synergy websites. Furthermore the following conditions and terms of use shall apply as identified in the paragraphs herein below:

​1.) Water Medium Synergy Gift Certificates and/or Gift Vouchers can only be purchased on-line from Water Medium Synergy in the monetary value shown in the drop down menu option on this website where different value amounts of Gift Certificates are listed or from the drop down menu in the amount of a particular product line selected. All purchasers of a Gift Certificate understand and hereby agree that their Gift Certificate purchase is full and final and non-refundable and non-transferable without exception for whatever reason.  

2.) Furthermore, purchasers of Gift Certificates and/or Gift Vouchers also understand and agree at time of purchase that their Gift Certificate or Gift Voucher holds no actual cash value and can not be redeemed for cash by them or anyone else at any time in the future for any reasons whatsoever.

3.) Gift Certificates and/or Gift Vouchers that are only issued by Water Medium Synergy shall be recognized as the sole official and valid tender for use towards the purchase of a "WMS service or product line" listed on this website where at no time shall anyone attempt to alter, make copies, reproductions or attempt to circulate a falsified Gift Certificate or Gift Voucher for any reason or purpose whatsoever - where any such discoveries (direct or indirect) by Water Medium Synergy shall result in the original Gift Certificate or Gift Voucher and / or any of its reproduced or falsified copies deemed null and void by Water Medium Synergy without further notice or compensation or refund offered in part or in the full amount to the purchaser and/or to the holder of a Gift Certificate or a Gift Voucher.

4.) Any individual or individuals party found in violation at anytime of any part of this "Gift Certificate" or "Gift Voucher" Policy set forth herein understand and agree that further legal actions may be brought against them by Water Medium Synergy and its rightful owner where fraudulent misuse of the Gift Certificate(s) or Gift Voucher(s) is suspected and/or found to be committed by anyone where any resulting past, present or future resulting costs, losses and/or damages of whatsoever nature that Water Medium Synergy and/or its rightful owner incurs directly or indirectly where such shall be pursued for compensatory relief and awards as available to Water Medium Synergy and its rightful owner under any and all legal avenues and options available including seeking reimbursement for any/all fees, damages and/or costs incurred by Water Medium Synergy and its rightful owner including but not limited to the costs associated with the legal action and/or legal proceedings brought against the named party.

​5.) All purchasers further understand and agree that Water Medium Synergy holds the sole discretionary right to revoke / invalidate a purchased Gift Certificate or a Gift Voucher at any time when suspicious or fraudulent use of a Gift Certificate and/or Gift Voucher is shown or merely suspected. Hence the purchaser and/or the holder of a Gift Certificate and/or Gift Voucher hereby agree to be fully bound by this police in the event their their Gift Certificate and/or Gift Voucher is found or declared to be null and void by Water Medium Synergy including agreeing to their absolute forfeiture of any and all reimbursement in part or in whole for the value of the Gift Certificate or Gift Voucher including forfeiting all rights to proceed with any further legal recourse for any claims of action sought out for any compensatory relief in part or full in the future against Water Medium Synergy. Furthermore all parties also understand and hereby agree that once a Gift Certificate and/or Gift Voucher has been nullified and voided by Water Medium Synergy for violation of any of the paragraphs found herein this policy section governing "Gift Certificates" and "Gift Vouchers" for whatever other reason(s) and / or at anytime whether in part or in full - shall further forfeit any claims of possession of their Gift Certificate and/or Gift Voucher and shall abandon any expectations of whatever nature to any types of claims for remedy and/or any reimbursement or award in part or in full from or against Water Medium Synergy or its rightful owner(s), affiliates, subsidiaries, successors, operators and / or assigns officers, directors, employees, sublicensees, or agents.

​6.) Every Gift Certificate and Gift Voucher issued by Water Medium Synergy shall be and is valid for a period of 12 consecutive months following its purchase date after which time if not used in part or in full can be renewed / extended for a one-time term of an additional 12 consecutive months period for a renewal fee payment of $25 USD. Either the original purchaser or the holder of the Gift Certificate or Gift Voucher can make the request to have their Gift Certificate and/or Gift Voucher renewed / extended for the said additional one (1) year term period with the provision that they email Water Medium Synergy at info@watermediumsynergy.com at least 1 month prior to the noted expiry date on their Gift Certificate or Gift Voucher. Upon receipt of their email Water Medium Synergy will issue an invoice in the amount of the $25 USD renewal / extension fee which will need to be paid on-line upon receipt and before the expiry date noted on their Gift Certificate or Gift Voucher being requested for an extension. Once the renewal payment of $25 USD is processed and cleared can the renewed Gift Certificate and/or Gift Voucher be activated and applied for usage according to the stipulated conditions and terms of use identified herein in this section titled "Gift Certificate and Gift Voucher Policy" and its applicable corresponding paragraphs. Failure of issuing the requested e-payment of the invoiced $25 USD extension/renewal fee for the expired Gift Certificate or Gift Voucher within 5 business days of receipt invoice and payment request shall result in the Gift Certificate and/or the Gift Voucher becoming permanently deemed as expired and null and void without further recourse or remedy. 

7.) In the event a Gift Certificate or a Gift Voucher is not used to purchase a "product line" being offered by Water Medium Synergy during the allotted term period it remains valid then that Gift Certificate or Gift Voucher will be deemed as expired and null and void without any claim by anyone at anytime for any reason for any compensatory relief or any remedy and/or any other type of expectation for any reimbursement or award or payment or credit in part or in full from or against Water Medium Synergy or its owner(s), affiliates, subsidiaries, successors, operators and / or assigns officers, directors, employees, sublicensees, or agents.

​8.) Water Medium Synergy Gift Certificates and / or Gift Vouchers shall be exclusively limited towards the purchase price point of any "product line" being offered by Water Medium Synergy as listed on this website. Anyone who purchases a Gift Certificate and/or a Gift Voucher further understands and agrees that any Gift Certificates or Gift Vouchers issued by Water Medium Synergy shall hold no monetary cash value, will not be available to being cashed in, sold or transferred by its holder to a third party at anytime for any reason. 

9.) If a holder of a Water Medium Synergy Gift Certificate were to select a "product line" that is priced at a higher price point than the value amount of their Gift Certificate holds and which they wish to use - then the person will need to email us directly at; info@watermediumsynergy.com to make payment arrangements for the difference in the outstanding price amount remaining. Upon receipt of their email we will email them the balance owed on their selected "product line" where their payment to Water Medium Synergy will be due upon receipt of their invoice and will need to be paid before they can be registered or receive that selected "product line" from Water Medium Synergy.

10.) In the event a holder of a Gift Certificate were to select a "product line" that is priced at a lower price point than the value amount their Gift Certificate holds - then they will need to email us directly at; info@watermediumsynergy.com to have the remaining amount value converted from their Gift Certificate into a Credit Voucher which shall be used by them as identified in the conditions and terms of use in the above section noted herein and titled; "Credit Voucher Policy". 

11.) To purchase a Water Medium Synergy Gift Certificate or a Gift Voucher in a specific amount to cover the price point of a specific "product line" offered by Water Medium Synergy on this website, we ask that you contact us directly by email at: info@watermediumsynergy.com and specify the "product line" and the corresponding price point amount that you wish your Gift Certificate or Gift Voucher value amount to represent. We will issue you a customized invoice for the requested value amount which will require you to proceed with issuing a payment on-line through Pay-Pal. Once your payment is processed will will issue your customized Gift Certificate or Gift Voucher that can be used by the person for whom it was purchased towards their registration in the named "product line" on their Gift Certificate or Gift Voucher which shall be governed by all the conditions and terms of used outlined herein this Purchase Policy.

12.) Persons who receive a Water Medium Synergy Gift Certificate and/or a Water Medium Gift Voucher are required to contact us directly by email at:info@watermediumsynergy.com to schedule their appointment for their session using the Gift Certificate and/or Gift Voucher they wish to redeem.

​13.) Water Medium Synergy Gift Certificates purchased for a specific "product line" are price guaranteed meaning that the holder of the Gift Certificate will be able to register for a particular "product line" over the next 12 consecutive months following receipt - even if that specific "product line" price were to increase during that time frame. 

14.) In the event an individual who receives a Gift Certificate for a specific "product line" were to decide they wanted to register for a different "product line" (other than what their Gift Certificate was specifically purchased for) - then all they would need to do is contact us directly by email at info@watermediumsynergy.com  to arrange to have their product line session switched over to another product line of their choice.

15.) In the event the new alternate "product line" (they wanted to register in) would be offered at a higher price point than the value of their Gift Certificate - Water Medium Synergy would issue an invoice for the difference in amount owed which would be due at time of receipt and before the start date and time of the "product line" they wished to register for. If the person held a valid Gift Voucher they could use it to pay for the outstanding balance of the selected "product line or service" being sought.

16.) In the event a "product line" being sought would be offered at a lower price point than their Gift Certificate value amount - they would receive a "Credit Voucher" for the balance remaining on the Gift Certificate where the conditions and terms of use as identified in the section herein; "Credit Voucher Policy" would apply and govern their Credit Voucher's future use and application. The same would apply if a Gift Voucher were to be used where balance remaining on the Gift Voucher would be transferred over to a new Credit Voucher.

17.) Once a Water Medium Synergy Gift Certificate or a Gift Voucher is redeemed in part or in full - any amount remaining on the Gift Certificate or the Gift Voucher shall be converted in to a new Credit Voucher where each of the applicable conditions and terms of use shall apply and govern as identified above in the section titled, "Credit Voucher Policy".

​REFUND POLICY:

It is hereby further understood and agreed by all users of any "product line" and/or Gift Certificates and/or Gift Vouchers offered or issued by Water Medium Synergy on this website that all payments for product line purchases issued to Water Medium Synergy are deemed "full and final" and non-refundable or transferable (in part or in whole) for any reason at anytime unless as stipulated otherwise in the above listed purchase policy sections herein.

Furthermore, Water Medium Synergy reserves the sole right to delete, amend, change and replace any parts or sections of any of its above noted policies and paragraphs herein at its sole discretion at anytime without having to provide individual written notice or notification of such changes or updates to anyone. Furthermore any updates, amendments or deletions made by Water Medium Synergy to any of its operational policies or terms of use or conditions in part or whole as found on this website shall take effect from the effective date, month and year noted herein and shall automatically replace and supersede all prior versions of cited policies, terms of use agreements that Water Medium Synergy had posted on-line or relied on in the past.

In addition, should a disagreement or misunderstanding arise between Water Medium Synergy and a purchaser and/or user on the interpretation or application of any part of any policy section identified herein then Water Medium Synergy's holds the sole discretionary right to issue a determination for resolution in any disagreement of events which shall be deemed as full and binding and non-revocable for any individual(s) directly or indirectly party to the matter in dispute.
